This is to address anyone who has purchased, is mid construction, or is in a legal dispute with WaveTec pools... My first phone call on Monday morning will be to a "Lemon Law" attorney in Texas.

If you think your problems getting the stupid thing constructed have been a nightmare... just wait. The hydraulic system leaks hydraulic fluid into the water as well.

We purchased our pool in May 2006. It was June 1, 2007 before the pool was fully constructed and we were ready to swim! By August 2007, I started noticing a black "grease mark" along the edges and near the skimmer. I removed the screen from the current machine to find that the metal couplings had orange and yellow goop all over them, and that the underside of the screen was coated in oil.

This is more than an inconvenience... My children swim in that pool, a petrochemical like the hydraulic fluid can cause deadly chemical pneumonia (if you haven't heard of it, it is why there are now safety caps sold on baby oil products.) All children will take a nose-full of pool water from time to time. This is a very serious threat to anyone who swims in these pools where the hydraulic fluid has leaked.

Wave Tec people have tried to tell me that it's a problem with Flagstaff water, and that our hard water is causing excellerated rusting of the couplings and that's why it's leaking.

I'm a graduate student at NAU, and the Chair of my department is the foremost Hydrochemist in the region, and he has assured me that's the most rediculous thing he's ever heard.

So, like you, I'm venting on this site, I'm out many thousands of dollars too, I'm disgusted by their business practices, and I will go to any length to get my money back and do what ever it takes to put these people out of business.

Luckily, Texas' "Don't mess with..." reputation bodes well for all of us in that their Lemon Laws are among the most consumer-protecting in the nation...

Wave Tec Pools has to be the most unprofessional company I have ever seen. 8 months ago I had a salesman come by to sell me a pool. He looks at my backyard and says "no problem, I don't see any septic tank or field here". I am new to septic tank as I just moved in. So I ask him outright " if there is something in the way, what happens"? He replies, "Oh, you get a full refund". So, next a surveyor comes out and promises me the same thing that nothing is in the way, and I would get a full refund if there were.

Then a lady, Mary Ann, Who by coincidence does not work for them anymore so they say, leans on me for the next 5500 check, and has my survey in her hand. She says the same thing as the others. There is nothing in the way and I will get a full refund if there is. So, with my initial $5500 and this $5500, I am in this for 11,000. 2 months go by and they dump a ton of equipment on the side of my house.

A month later they finally come out, dig a big hole in the backyard, hit a septic pipe and say, OK, we can't put it here. We will be back in touch. A Month after that they send 2 guys who can't speak a word of English, and they proceed to paint a pool outline in my FRONT YARD. They say, "we start dig now". I said, no you don't. I proceeded to contact the office, and 10 messages later I get Mark Daniels. He comes by and confirms that the placement is ridiculous. He then says, "Ok, so you want to cancel? We will charge you 30% of the total pool!" That’s 30% of the $22000! I proceeded to tell him about everyone telling me I was getting a full refund, as nothing was done, the equipment they had on the side of my house they said did not have to be ordered as it was a cancellation from another customer, and I have a hole and punctured pipe in my backyard.

I was trying to settle this amicably, so I said, "OK, lets try to work this out". Mark Daniels says "OK, I will bring this to my CEO and try to get this worked out. A Month goes by with me leaving no less than 15 messages. Finally he calls me back and says, "Oh, we are putting a settlement together now". That was 2 months ago! I leave message after message with no response. They basically robbed me of $11,000 and have not contacted me since. They have 43 complaints with the Attorney General's office, 84 unresolved complaints with the BBB.

These people are outright crooks and need to be shut down. Now I will settle for no less than a full refund as I have to get someone to fill the hole in my backyard, fix the pipe, and replace all the grass that was ripped up from not only the hole, but the equipment that killed all of the grass on the side of my house.

I was sold a Wave-Tech Pool (32K) + financing for $4K in a retaining wall to support the pool. I paid $2K cash down, for a total expenditure of $34K. I have since found blogs and internet postings of over 43 complaints with the Attorney General's office, 84 unresolved complaints with the BBB. When I first looked into the company, the standing with the BBB was good, unless you yahoo-search "disaster" and "law suit" and Wave Tec Pools you are unable to discover the hundreds and hundreds of people who have been destroyed from Wave Tec business practices. I don't understand why they are still allowed to be in business.

Here is my story - these are only the highlights, the rest of the "pain" and frustration over the last 4 months is too lengthily to compile.

The first contractor did the following:

A. Disregarded city approved permit specs, refused to dig in area that was permitted then Dug the pool in the wrong area, placed walls up unleveled which created an "above ground" pool. This placement was not permitted and the entire pool bracing had to be dismounted, leaving a 12' x 20' hole in the center of my yard with a mountain of dirt behind it, over 16' tall.

B. Erroneous and Unnecessary Trench: The 12ft long, 4 ft deep trench along the side of my home -- beginning at the main juncture of my sprinkler system pipes in the back yard, when only six inches was necessary. They plowed through the red flag markers that indicated where the electrical system and sprinkler system was.

I have to attend an "Architectural Board Committee Review" from my homeowners association and face fines up to $50+ monthly until this is resolved.

C. Next Contractor came, WaveTec agreed to have this new contractor extract the dirt from the yard from first dig and haul away, I agreed to the comprise to dig then deeper and put more money into a retaining wall.

D. Contractors took the dirt to be hauled away and instead, put the dirt back into the first dig, leaving now a large mound in the original hole.

E. Contractors dug the second hole, but not deep enough and very very very unleveled, but still placed pool wall bracing. contractors requested the second "check" from Superior funding, turned into WaveTech. The contractors then abandoned work and the site.

F. Contractors cannot return phone calls because they say they have a "problem" with WaveTec, compensation for work that is due to them, etc. etc. etc.. They have walked off the job and will not return.

G. WaveTec refuses all phone calls and will no longer reply to emails.

H. Superior Funding, of which i found out is owned by the same person that owns WaveTec, Curtis Batts, calls frequently for monthly payments of which I have sent, but they cannot seem to find.

I. I am writing to determine if there is a class-action law suit, to get my own attorney to pursue in full or to have some kind of intervention into this situation.
