Real Advise from a Rickenbacker Rep
As a representative of Rickenbacker Collection Services, I have some valuable information for readers who have an account in collections with our organization.
First and foremost, if you receive a notice of collections, immediately contact the collection agency. There may be a pending credit reporting action and ignoring the collection notice will not help you.
If the account was placed as the result of the towing and storage of a vehicle:
If you sold or transferred the vehicle to another party prior to the tow date, there are options available to you:
1. Provide a copy a notarized Bill of Sale, signed by the seller and buyer prior to the tow date
2. Provide a copy of an acknowledgment from your state’s titling office, indicating that the transfer took place prior to the tow date
If you were the owner of the vehicle at the time of tow:
1. Every state has a provision that allows the towing company to charge for the towing and storage services of the vehicle.
2. Turning the title over to the towing company does not extinguish the debt.
a. If the vehicle is sold, the sale amount is applied to the towing and storage fees.
b. If the sale of the vehicle does not cover the total fees, then there will be a deficiency balance.
i. The deficiency balance is what the towing company submits for collections.
c. If the towing of the vehicle was the result of an accident, consult your insurance policy.
i. if the policy does not cover towing and storage costs, then it is the responsibility of the owner to pay for the services of towing and storing the vehicle.
ii. If the policy does have this coverage, then a claim for the towing and storage must be submitted to your carrier according to the guidelines of the policy. Consult your insurance representative.
If the account was placed as the result of a credit transaction, medical service, retail purchase or any other type of service or purchase.
The original creditor will be named in the first communication notice from the collection agency. Gather all of the records and documents you have available regarding that transaction. If you dispute the debt for any reason, send your explanation of your dispute along with a copy of your records, to the agency from which you received notice. This will initiate an investigation of your dispute. It is also recommended, that you follow up with the agency by phone around 10 to 14 business days after the date of your letter. Many agencies will accept communications by fax and/or email.
You have the right to dispute a debt which you feel you do not owe. If you know that you are responsible for the debt, many agencies will accept a lower settlement payment to close the account or work with you to set up a payment plan that meets your budget.
The most important thing to remember is that ignoring the debt, yelling at the collection agents, and sending threatening letters to the agency will not resolve the debt. Communicating in a manner that is of the interest in resolving the debt is more effective and more for your benefit.

EWING BROS.
Ewing Brothers tow a car i use to owen which was sold in Dec 2008 plate were surrenderd to DMV there trying to bill me $1, 747.88 ive sent them copy from thee DMV showing i surrenderd the plates and havent been responsible for this car since Dec 2008 but they keep calling my phone and threating me all hrs of the day &night they told me i was the last registered owner there for im responceable for the bill i cant help it if the people i sold the car to didnt register the car i did what i was suppost to by surrendering the plates to the DMV . please can you help me!!

Rickenbauer is trying to ripp me off with an unexisting debt
I received a letter from Rickenbacker Collection Services notifying me I have a debt with them for $315.00 for unpaid medical services with one of my old Medical providers (Centro Medico Miami). This clinic went out of business around March 08, dissapeared from the city without notice or warning, but they collected a month in advance my membership. Months later, around June 08, another medical providers with similar name (C1 Medical Center) sent me a letter telling me they were taking over the customers of the former CMM, and offering me to joint them in a new contract. I gave them a strong NO and explained them my dissapoinment with their way to do business. 4 months later, I received the letter form Rickenbacker for unpaid medical services with C1 Medical Center that I never used back in December 07, when I still was a member of CMM and C1 Medical Center didn't exist yet. I called Rickenbacker and I was told if I didn't paid, they were going to screw my credit. I contacted C1 Medical Center and they HAD NO IDEA about this! They mentioned they were trying to get the old patients from CMM, but never sold no debt to any collection agency.
I did a quick research on the internet and I found tons of complaints about this people, and I think they are just plain thieves. My next stop will be the police station.

verbal abuse, harrasment
I unlawfully received a collections letter stating that I owed RICKENBACKER over one thousand dollars for a car i never owned. I called the 800 number to get more information and was treated so horribly. I not only didn't receive any help the woman I spoke with refused to give me their names, laughed at me and lied saying i called them names when in fact I hadn't done anything but try to get infofrmation. I was given a clearly fake name and then maybe two legitiment names - MONICA, who was the supposed supervisor and LATISHA. Both these woman were incredablly rude and verbally abusive. How is it legal to be treated like this when they sent me a collections letter with no proof, nothing stating I am responsable for a vehicle I never owned. This is unacceptable and infuriating. Is this business even legitimate? I am seriously considering taking leal action against them.

Janice/ Cynthia, customer rep.'s
I called the collection services phone number regarding a collections bill I had received for a hit and run car accident that I had been in. When I called the first 2 times the women that answered had put me on hold with out even saying hello, then hung up on me. When I called for the third time I spoke with a woman named Janice. I started off by telling her of my situation and tried to figure out a situation of making payments. Throughout our whole conversation the woman had a sever attitude with me, saying things such as "do you think you're the first person to call me telling me about a car accident?" and "well car accidents happen and that is not our problem." There was at no time within the phone call where the woman was the smallest bit polite or even civil. I then asked to speak to her supervisor because she had an attitude, where she then lied and said that she was in a meeting and that she "hasn't even started with an attitude YET." and then hung up on me. I called back and when the woman picked up she proceeded to put me on hold, where I could hear her laughing and talking in the background. When she got on the phone with me I told her of my previous situation in calling in, and she told me that she was Janice's supervisor. I told her that Janice's attitude and whole manner with me was unproffesional and un-necessary. I told her I was trying to work my situation out, where she started on her same speech about my situation with even MORE attitude than the first woman. I told her that I was just going to leave my bill in collections since the amount was wrong and the people I was dealing with (her included) were rude and obnoxious. I asked to speak to her supervisor and she said that JANICE was her supervisor, and when I asked her why she had told me she was Janice's manager she completely changed her story.I then just hung up, after spending almost 45 minutes wasting my time. I know all they want is my money, but that is FAR from what they are going to get.
