There is hope!
You can possibly get away. I contacted HOPE through the program Presidet Bush said would help, not may on the list would even consider it. The NACA is the only ray of sunshine to help us with Homeq. They went to congress with a plan to help people stop foreclosures. They took down Fleet and Ford Associates... Their latest complaint included HOMEQ aka BARCLAY. Demanding that they bring in CEO's of the bottom 10 lenders that say they will refinance but they don't. Here is that link https://www.naca.com/press/FSCTestimony20071101.pdf

We have started to process with NACA and hope to get away from Homeq. Try them, they might be able to help. They do not look at credit rating. They look at ability to repay. You qualify if you have a predatory rate (10% or higher) I would say 90% of their mortgages probably are. I can't afford a lawyer, my last hope is the NACA.

Rip off!
I hate this company and the unfair practices. I have recorded phones calls and they will hang up on it. If it isn't illegal what they are doing what is the problem after months of searching for an attorney to help i found a site that is looking or your story...

Search james hoyer homeq servicing. I think he may be taking them on. I would be so happy to see them going down.

Overcharging consumers!
Well, HomEq has done it again., check this out. Total Past Due Payments $6,880.36, Forecasted Payments for Plan Period $10,320.54 ? Accrued Late charges $58.61, Forecasted Late Charges $351.66 ? Returned Payment Fees $25.00, Corporate Advances $102.34, Net Amount Due $17,738.51? The amounts in question has the question marks. Can someone explain to me what is this? Does this mean that this company is getting an extra amount of money that total $10,672.20? This is stealing. All of my papers work will be turned over to the FBI.

How can they do this, and get away with it? HomEq is acting on the behalf of Deutsche Bank National Trust Company. As soon as I find out the web site and address and telephone number of this Bank I will give it out. Just maybe Deutsche Bank National Trust Company do not know that HomEq is getting this type of money from people. Now this is a payment plan for a person that is behind only $5,243.88., but has to pay back a total of $17,738.51.

Fraudulent practices!
I recently re-financed my mortgage with Countrywide to get away from this nightmare of a company. However, after closing, I have been informed that I still have a balance due to HomeQ. What?! Are you kidding me?! HomeQ Servicing sent a letter to Countrywide with a payoff amount and then when they received that amount(which they have yet to post) they said that it was short and so they have not posted the payment of $75,535 because they claim there is a $600 shortage which they are still charging me interest on daily. I do not understand how they can do this. I was stuck with them for two long years. I always paid them their money and their fees when they were due. However, I encountered so many problems with them. They do harass you nonstop even when they have your money, they do not inform you of supposed incorrect routing numbers until the grace period has elapsed and they charge you a late fee, and they are very, very rude when they call you five times a day. I am sorry for everyone who has to continue to deal with them, I hate that I have to deal with them over this supposed shortage, but there has to be a way to get this company to run a reputable operation or get the hell out... One more note to all the supporters of HomeQ, I sure do hope that you never have to go through this, It is wonderful that you have been blessed with the ability to pre-pay all of your bills all of your lives. Unfortunately, some of us lost our jobs as a result of 9/11, Katrina, etc. When a hardship such as that presents itself it is difficult to get through each day without putting a bullet through your head. All of us "bad credit low lives" probably had to make tough decisions such as wether or not to take our children to the doctor, or go buy groceries, or pay the electric bill to stay warm in winter, or of course, pay the mortgage. Just because we made the choices to eat or provide warmth and healthcare does not mean that we cannot manage our finances. There are times when tough choices have to be made and we made them. That does not negate our rights as human beings and US Citizens. We deserve to be treated fairly no matter what our credit rating is. The benefits for perfect payers is that you get the great rates and get to save thousands of dollars that we do not, not that you get treated better. So do not consider yourselves better people, because you are not! You only have more money.

Electronic checks, Assisted check by phone
While reading through the complaints I came accross the comment by Unknown who claims they are a former employee of HomEq. I can almost guess who this is. I can bet that they are not a FORMER employee but a current one. In their comment they suggest that you submit a future payment by phone. PLEASE!!! Don't anyone do this. That is how they got us. You should NEVER submitt an electronic check to these scam artists. The only way to have any security in making a payment is to send it certified. Make copies of anything and everything you send them. Get a return address receipt. You must guard yourself in any way you can to make sure they receive your payments and process them in a timely manner. We all know they are all trained to post your payments late. Take caution.

Customer harassment!
HomEq Servicing has called me twice in October, 2007 before the 16th, when my mortgage is due. My mortgage was sold to HomEq without my consent by Home123 when I refinanced two years ago. I have always had from the 1st through the 16th to pay, as it CLEARLY SAYS ON MY MORTGAGE PAPERS. They need to stop harassing customers and they need to pay me a ton of money for ruining my health with stress. A recent retiree.

Illegally harass, lies and deceitful practices!
I read Alan’s complaint regarding HomeEq Servicing. It’s amazing to me that this company is allowed to illegally harass home owners with their lies and deceitful practices. We are also victims of this HORRIBLE company that call themselves debt collectors. They make sure that you keep behind in your payments. They constantly harass you saying that your payment was not received or the bank rejected it. Even though my bank has no record that they tried to cash any of my last 2 payments. These check numbers are also missing on my statements and show as skipped numbers. They were paid by phone as electronic checks. I have since put stops on these checks. I was finally able to get them to accept a payment which was sent by cashiers check. It was cashed on the 10th day. The last day before we could put a stop on it. Which we were going to do. I was smart enough to write the check number that the cashiers check was replacing. Every time we send a payment it seems there is some kind of problem they have with cashing it. HUMMM!!! Somehow we are always in default and always owe late fees. We have been threatened with foreclosure, treated very rudely, denied access to a supervisor on many occasions. Feeling very frustrated, I began a search for complaints on HomeEq Servicing. I found the Ripoff Reports on HomeEq Servicing. WOW!!! Over 300 complaints. Many with similar stories like mine. They threaten people with foreclosure unless large amounts of money are paid. The amount of payoff on the account never goes down, because they hold your checks so they can charge late fees and other charges that they can’t even account for. We are unable to refinance because they have us in arrears. We have recently filed bankruptcy and at least the lawyers have to deal with them for the next five years, but I am truly worried that when that time is up they will be back to their evil bullying that they are known for. We need help in our fight. We are stressed out!!! We have asked numerous times to talk to a supervisor to which we are always denied. They make false promises saying one will call us at 6pm CST. The time comes and goes with no contact. We would like to take part in any class action suit that is being sought against HomeEq Servicing. If someone would contact us via the above e-mail we would certainly be grateful!

Predatory lending!
I have owned my own home since 1988 and never missed a payment. I have asthma and a sensitivity to perfumes and chemicals and other toxins. In 2003, my then employer ignored my needs. As a result, I breathed in some toxins sprayed at work. I could not breathe and catch my breath. I was left writhing in pain on the floor for 45 minutes in front of a room full of people before an ambulance was called. By the time I got to the hospital, my stomach had perforated resulting in emergency surgery and a $15,000 bill, which the employer or its insurance company refused to pay. I also lost my job for reporting the situation and tried to obtain worker's compensation to cover the income losses and get help with the bills. As a result of the outstanding hospital bills, I could not get treatment to be able to heal from my surgery properly. My former employee threatened me for reporting them.

I was deep in debt from the medical bills and credit card debt. At the same time, I became fodder for identity theft. While I was on pain killers. A telemarketer from a software company, Smart Certify billed me for $3,000 for a web design course I did not authorize on an MBNA credit card. Smart Certify and MBNA would not remove the debt and it went on my credit report. Before the surgery, my FICO score was 710.

To avoid bankruptcy, I attended a seminar with others in Cedar Rapids, sponsored by Financial Rescue Services and the National Consumer Council for debt settlement. My debts were settled for pennies on the dollar. I filed for financial assistance for payment of the hospital bills. I was told the application was approved and the debt was cleared. Yet, the 3 credit reports (Experian, TransUnion and Equifax) and still are reporting the medical as collection accounts, when they are not and the MBNA does not have the fraud disclaimer I requested. I was trying to heal from my surgery and the terminal illness of my mother from colon cancer.

Household Finance was paid off as part of the settlement, yet I am still hounded and harassed by collectors. My home mortgage was refinanced to clear off the debt by Financial Rescue Services. My mortgage loan was sold in 2005. I was living on income from bonds I had inherited. An ex-friend, which a substance abuse problem broke into my home and stole the bonds. Even though he couldn't cash the bonds, it took 2 months to replace them. I was never notified that they were taking over my loan.

At the same time, my youngest brother was injured in a fall down some stairs, sustaining a serious brain injury. I explained the situation to Homeq Servicing Corporation, the company who took over my loan. They seemed to understand, yet many things happened. They took advantage of my situation and that's when the hassle began.

Thanks to Homeq:

1. They canceled my home owner's insurance (which I had had since 1988) for $500/year and replaced it with a policy for $989/year and told me I couldn't have other insurance. (this is a practice called “forced insurance.

2. My payments were increased from $500 to $800/mo which violates my mortgage, without legal notification.

3. Payments have not been applied even though I have shown proof of payment of checks cleared through my bank. So I am being told I am behind and in breach, when I am not. It is now on my credit report and I have been accessed late fees. They have destroyed my credit by reporting late payments, which have been made.

4. Still continue to charge me for an escrow account, when my interest and taxes are included in my mortgage payments, according to my mortgage deed.

5. I have been called a deadbeat and profane names by collectors even at 10:00 pm as well as “f—ing sh*t” and that because I am a low-life deadbeat, I do not deserve to be treated fairly and that they can do as they please and there's nothing I can do about the situation. I even sent Homeq a cease and desist letter and they still call.

6. An "attorney" called telling me that if I didn't make payment and if I reported them to anyone-I wouldn't have my home and job and I needed to pay in full by July 1st or face foreclosure. He wasn't an attorney but posing as one, which is illegal.

In my research on predatory lending, I learned that my current mortgage which was financed by Financial Rescue Services through their bank, First Financial Bank NLC in California contains illegal items:

1. The HUD settlement statement has illegal fees charged by the bank they cannot charge.

2. I was promised a fixed rate but got an adjustable rate mortgage.

3. My truth in lending and good faith estimates have 2 different rates, which is illegal.

4. My interest and taxes were financed as part of the loan and yet appear not to be part of the loan, which is illegal.

5. Did the loan you got at closing turn out to be very different from what you were promised? Is the rate much higher than the lender led you to expect? Did you think you were getting a fixed rate loan, and end up with a variable rate loan which can only go up from where it started? Were large fees financed into the loan? Were you looking for lower payments only to find that you now have to pay your taxes and insurance on your own, outside of the loan? Yes

I learned that in 2004, Financial Rescue Services and the National Consumer Council were shut down by the FTC for fraud and failure of full disclosure. (Court Closes National Consumer Council )

Because I don't have the money, I cannot obtain adequate legal representation. The Iowa Attorney General has referred my case to the Office of the US Currency, who are slow to act even after 2 referrals by the Attorney General's office. People are losing their homes because of this fraud and I don't want to lose mine. I have home repairs that need to be made (leaky faucets and gutter cleaning to clear out trees that have grown) and haven't the money to do so. The stress has been ungodly because of the harassment and red tape. My loan is owned by Wells Fargo who is known for predatory lending practices (Links and Information. )

I am asking for help in stopping the practices by Homeq and that my credit report is cleared of all negative information, restoring my FICO score and the negation of my mortgage and being paid in full due to fraud. Just because I am lower-income, does not mean I am beneath anyone and deserve to be treated fairly.

Lockbox research problem
This company has got to be the worst company to deal with. The people that works there as a rep are rude, unprofessional, lazy to research and just have attitude. I recently encounter a problem with them where I sent my payment to their lockbox operation, two weeks later the payment was not posted to the accounts and when I called Homeq Servicing trying to figure out what happened to my payment, they tried to lecture me about the better system to use to make payments if I want my payment to make it there on time. They tried to make it sounds like I was lying although I had a cashier's check copy to prove how I sent my payment, they did not want to honor my copies, they did not want to research or get in contact with their Lockbox to find out whatever happened to the customer payment instead they threaten to foreclose my property if payment is not rec'd since it became a he say she say type of thing. I got the Bank of America involved since I purchased the check from them, had Bank of America checked to see if the check was ever cashed which was not. The nightname went on for days, then finally a rep decided to accept the copy of the checks for them to do research & would call me to let me know the outcome. Instead what Homeq Servicing did after two weeks of going back in forth finally posted the check to my accounts and never called me to this day to tell me that they had in fact rec'd the check. I am in the process of finding out what I can do about them.
