Remodification loans
I was struggling with my ARM mortgage last fall as I was laid off by Bank of America and unable to find employment. I was sent an offer by Countrywide to modify my loan at a much lower interest rate effective September 1, 2008.
I eagerly agreed and accepted the offer. I was then able to keep my home and would hopefully be able to refinance at a later date. Since September 1, 2008, Countrywide had delayed processing the modification (because they are so busy so they say) and because of that they have reported me as being 120 days late in payments. Of course, that is not true and negatively affects my credit rating. However, I have called repeatedly for the past 6 months and have talked with no one that knows what is happening, not interested in even pulling up my information, have been hung up on, argued with, and still haven't been able to find anyone with any authority, responsibility, desire, nor ability to resolve their error.
As a final attempt I have contacted their Office of the President to see if this matter can be resolved. And could I refinance with this type of credit bureau reporting? Absolutely NOT!
I am so frustrated with their Customer Service and what is funny is that I worked for Bank of America as a Customer Service Manager for 7 years and can't believe that this lack of training, lack of authority, lack of customer service abilities, and apathy is acceptable much less pervasive.

SCAMS
I have been faced with financial hardship and fell behind on my house payments. On January 1, 2009 I received a certified letter from Countrywide stating that they understood that I was going through a difficult time and with the HOPE team they were going to refinance my home, making me current on my back payments as well as lower my monthly payment from 1580 to 1240. The letter stated that I needed to have it signed and notarized and to return it in the pre certified envelope enclosed by Jan 27, 2009. Effective Feb 1, 2009 I would restart on a clean slate. I did as instructed. Sent the letter of on Jan 15, 2009. Feb 11, 2009 I was informed that my home was going into foreclosure. When I spoke with the representative at countrywide I was told that they never received my signed letter. The envelope that was provided only had one address on it in the sender section and the return to sender section which was COUNTRYWIDE. So how in the world did that letter just disappear? I informed the representative that the letter was returned. She informed me that because they have no record of it I no longer qualified for the HOPE team modification. HOW CONVIENENT! So now, they are not willing to work with me at all. They want me to pay back all the late payments at once. 6500.00 or my house will go into foreclosure. I asked them to help me. I was instructed to get a second job to make my payments.

They have some REALLY great folks at CW and some REALLY bad ones! There seems to be no in between. All I can say is I sure hope they really ARE monitoring the calls because the woman I spoke with tonight misinterpreted everything I said, acted like I'm trying to get out of payment, and then refused to identify herself.
I've already paid this month, on time and IN FULL, as I have every month for the last six years. However, since losing my job I just wanted to see if I could have the insurance and taxes taken off the monthly payments and put on yearly instead. That's all...That's hardly the same as saying I don't want to pay. The "loan consultant" said I couldn't just "avoid paying til the house sells", ...hunh?? My house isn't even for sale.
She was SO rude that, when I asked for her name, she refused to give it, so she KNEW she was being rude, and wasn't listening well. I asked again for her name and she refused again, then she transferred me back to cust. svc., which was closed.
Not exactly the "world class" svc. they advertise on their site.

Mortgage Fraud
When we starting house shopping we didn't quite have a down payment. We were in the process of setting up a loan through Countrywide and were advised by the loan officer to amend our 2008 tax return to add the 8, 000.00 1st time home buyers credit so that it can be used towards our down payment. While my family and I were doing some research we were advised 3 different times by 3 different people with the IRS that NO IS ALLOWED TO USE THE 8, 000.00 TOWARD A DOWN PAYMENT. If this done that we would be fine and or panelized until that money is returned to the IRS. Another loan officer said that it's considered mortgage fraud. As soon as we found this out we called the loan officer with Countrywide and advised that we were seeking other options and that we no longer would be going through Countrywide. The loan officer then said, " Just to let you know... not many lenders will accept the 8, 000.00 to go toward your down payment." I then said, " Of course, because it's mortgage Fraud!!! It felt soooo good not to be sucked into Countrywide and their schemes!!

Forced Flood Insurance
I received a letter from Countrywide stating I had to have flood insurance on my property because according to FEMA I was in zone AE (a flood area). I contacted FEMA who had me download their insurance maps. I am clearly in zone X. I called and faxed the FEMA maps with no results except a headache. They totally refuse to acknowledge the maps, even though its the exact same map they said they used for their determination. Their letter also informed me that if I do not get my own flood insurance they will take out flood insurance from my escrow with, surprise, surprise, Countrywide Insurance Company. After almost three weeks of arguing and faxing it looks like this will be going to court.

an inaccurate past due amt. on loan
Countrywide is showing we have a past due (30day) amount of $1, 208. We were approved for a loan modification on Acct#115512750. The new payments are $1585.24 @ 3% interest for 5 yrs. The amount they say is overdue is the old loan monthly payment of $1, 208. The paper work we have shows the restructured amount was approved for September 1, 2008 through Aug.1.2013. We have called and called to try and tell them we have the approved paperwork for the new amount that we HAVE BEEN PAYING ON TIME EVERY MONTH, yet they are charging us late fees on the old amount. Please fix this. Thank you.

Resolution/workout program
Called Countrywide in beginning of October /08.We couldnt make payment, husband lost full time job.Asked help, asked for a defferment of a couple of months SINCE WE WERE NEVER late with our payment before.They said we were still current, =no help.Called again and again.Faxed over papers of our financial situation on oct.10.08 they told me they would give an answer in 30 days.I called after 30 days, they told me NO you misunderstood, we said 60 days. That means that i will be 3 months late on my loan, and guess what thats my way to foreclosure. Still today, they have no anwer.Unbeliveable.Very disappointed.

realestate fraud
December of 05 iI had entered into a contract to purchase a house. My mortgage broker had asked me to buy more time as he was looking for a way to find me a loan. I made a deposit of 5k, then another 130k from an equity line he procured for me on another house. A day before close of april7/06 he notifies me that in order to 'get through escrow' I was to sign over the interest in the escrow to him and after close the following morning it would be replaced in my name. This has not happened.
Since inception of the lawsuit it has been discovered that- he had been preparing, signing, and forging documents in the escrow office without my notice from him or the escrow between feb28-march31 06. That two days prior to the assignment of my interests, and well after my over 100k deposit, he had aplied fraudulently, had approved from his superior, AND was underwritten by Countrywide for a mortgage and a HELOC in the amount of 50+k! The 50k$ was used to buil;d a pool and yard at his present house. the loans miraculously were underwritten and funded within 2days and without a purchase contract or any suportive evidence that he was to purchase this house. Basically he was enabled and coluded with to defraud me.
A year has passed, Im waaay out of money for my attorney, The broker has now filed chpt.7 after numerous other stalling tactics by his sleaze lawyer and Countrywide has done everything from denying his employment(since proven) to saying it was them that were defrauded as well. Nevermind that they had the last call, this is what underwriting is based on according to law.

Monthly Statements / Late Fees
Fraud alert, I believe every one of the 2 millions countrywide customers should read this letter I am sure it will benefit them as long as they are dealing with Countrywide Mortgage Company.
Throughout the pas 2.5 half years that we have a home loan with countrywide, we are receiving monthly statement and envelop to mail out our monthly payments. During the last two months we did not received any monthly statement and if it was not because of my wife we would have be late on our monthly payment.
After many calls to countrywide customer service they have informed us that the statement has been return to them with the note “Wrong address”. We have contacted post office and countrywide to get to the bottom of this issue without any success, and I must remind everyone that we have two loan with countrywide and we are receiving the second loan statements but not the first loan.
By the language of the loan documents customer is the ultimate responsible person to pay the mortgage and they need to use all means to do so, however when you receiving statements every month for the past two years or as many month and years that you are getting the statements, you may get used to this method and system and you may waited for you statements and as result you may be late on your mortgage payments.
This is extremely important and you may ask why and the answer that question is as follow;
1. This will have negative effect on your credit report and your credit score.
2. If you miss any payment as everyone knows there will be late fees involve with that and that is ONE WAY FOR THEM TO MAKE EXTRA MONEY.
3. If you are looking to take advantage of HOUSING RESCUE BILL that it was pass in summer, guess what!!?? Since you are LATE on your payments you will not be qualified to apply or take advantage of housing rescue bill.
4. If you are late in your monthly payments countrywide does not have to work with you and simply they can say get out.
I believe the reason that Countrywide does not send statements to the customers or when you pay online and on time yet they claim that they have not received the payments on time is that they want to make sure that the customers our late which will allow them to collect more late fees, disqualify the customer for any program that will REDUCE THE PRINCIPALS OF YOUR LOAN, and or any Loan Modification.
Countrywide is a incompetent, dishonest, deceitful company and they do anything to take advantage of the customer. Their incompetence has lead to the lost of identity of 2 million customer and they did not inform their customer for OVER TWO years their must be some law against that and consumer should take some legal action about that.
If you experiencing some of the above conditions and more please speak up and lets get together and see if we can put an end to the COUNTRYWIDE PIRACY of customers from their livelihood.
