Stay away
This company has the worst communication and customer service ever!!! No one knows the same information, there are too many people working on your account, and they do not care about their customers. If you have the options to use another company as your lender...PLEASE GO WITH THEM AND NOT COUNTRYWIDE...THEY SUCK!

Unfair Business Practices
I am filing a complaint against Countrywide Home Loans and Bank of America for unfair business practices, harrassment and fraud. In 2006 Countrywide's refusal to negotiate the loan and monthly payment of my home, refusal to answer my letters & calls for months and over a year. Talking to several people from their office ohn the phone with no sucess. They continuely raised the payment and the interest rate after they said they would not, they knowingly also impounded my taxes into my payment without my consent knowingly after all the calls I made saying I needed them to negoiate the loan. This was the main cause I could not keep my home. I had made two monthy payments out of fear of $4000 each well over $8000 and they continued to harrass me and not assist me with help. I tried to sell the property quickly, I got ill from it all, emotionally and physically with huge stress. This has made me lose my entire life investment and ruin my credit. Three years later, I am being harrassed still monthly by Bank of America who assumed the loan. I could not sell the property and my realitor advised me to move out so it could sell it. Scared I moved within two weeks of her telling me to do it, and I rented a small place. Countrywide accused me of ambandoning the property and proceeded with threatening letters of foreclosing on the property. They told me that I no longer qualified for the modification loan that was offerred by them which I had tried to get before moving and they denied me. Their explanation was I moved and wasn't residing on the property. Some of my belonging were still there. Bank of America assumed the loan. Bank of America has been harrassing me montly since with payment invoices for over $5000 per month plus interest even after my calls and notifications that the property is out of my possession for over two years. They have also contracted with a company that sends me a bill montly to insure the property "Reconstruct". I have called and told them also that I am not the responsible person any longer for this loan and I have never signed any agreements with Bank of America and it is now a surrendered property through the Federal Courts. I want to file a complaint against both companies Countrywide and Bank of America for harrassment and breaking the laws under the Federal Rules of Court which protects consumers against these type of practices. I want to seek damages for the entire amount of what my house sold at auction for on September 27, 2010 which was put up for auction last month in the amount of $725, 000 plus interest. I want at least one million in damages which includes the emotional stress against my family, my health the loss of income, my life savings and investiment and the time that I spent on the phone talking to the Countrywide and Bank of America employees which were different everytime. I ahve documentation of all the letters and people's name who I talked to and made sure that I document their name so that when I set up a telephone conference I was prepared to finish the conversation. Countrywide made dates to talk to me but broke every single one of them. This is not right! This is why Americans have lost their homes and life savings while the mortgage companies continue to eat up the properties. The interest alone that they have raped us for, all of us would pay for the property that we have lost outright.

Join the fight
This is to all who have had a problem with Bank f America/ Countrywide and been mislead and subjected to predatory lending. I have begun a massive movement to help those who have been faced with the same lies and high priced mortgages and foreclosures that we all face. I need everyone who has ever had a bad experienced to email me so that you can join the fight. There is power in numbers and I plan to be over a million strong and plan to effect BOA bottom line. We need to send them a message that we the people have the power

Refinancing problems
I have two houses with Countrywide mortgages. I applied in March, 2009 two refinance both loans to a lower interest rate. I was not behind on payments, I did not want money out, my loan-to-debt ratio is fine. I filed the appropriate paperwork, for each mortgage to be at 4.65% . Suddenly, the paperwork was "lost, " the appraisal for one of the houses was "lost, " and therefore my file was not completed on time, and the loan process for both loans was closed. When I complained and said that I wanted to re-open them, I was told that the interest rate was now 5.75%, that my credit score had gone down in the last several months, and I might not even qualify for that. I wanted my $800 back --- representing the $400 up-front fee that they charged me for each loan. They refused. I called, left letters, faxed, emailed -- nothing. Right now I just want my $800 back since they lied to me about the paperwork not being in on time, they lied to me about the appraisal paperwork being "lost" (it turns out, by their own admission, that the appraisal on one of the houses was NEVER EVEN DONE by them) ---- AND...I shouldn't have had to pay the money upfront, over the phone, before the loan process had even officially begun. Please help. My husband has been out of work (he works in the construction industry, which is DEAD), and I can REALLY USE the $800. If I try to refinance, it will NEVER BE WITH COUNTRYWIDE/B of A AGAIN. Thank you.

Fraudulent business practices
I am homeowner who pays his mortgage on time but I am not able to refinance to take advantage of today’s lower mortgage rates due to a decrease in the value of their home. Countrywide refused to help me refinance under Making Home Affordable program without any specific reason …just because... although I checked my situation under Making Home Affordable website and I was qualified.

In January of 2009, my husband & I decided to try to get a loan to purchase a home. We had two friends that had been pre-approved for a home loan, young like us so we asked ourselves, "Why not us?"
I got in touch with a family friend who referred me to a loan officer working for Country Wide. She told me that I was pre-qualified on my own. My husband doesn't have the best credit so we figured that was good news.
We started looking around at houses, had offers on a couple that just didn't work out then found the (1st) home of our dreams!! Beautiful, 1 story house in Goodyear, Arizona. Perfect for us & our children. It really sounded too good to be true, & we later found out why.
We made our offer, they accepted…(THEY being Fannie Mae) & we started the process of getting this house to be ours.
We paid the inspection fee: $295.00, the earnest deposit: $1000, & the appraisal/credit report fee: $490.00.
We were supposed to close on March 11th & we thrilled to be first time home buyers about to buy such a beautiful home! Another plus was the $8, 000.00 credit for first time home buyers we thought was going to come our way!
Come March 9th, we receive a phone call from our realtor saying that they needed more time. He & the loan officer just got off the phone & they weren't going to be done by the 11th. We needed to sign an addendum for more time.
What I forgot to mention: The property manager for Fannie Mae was just a jerk. He said that if it went past March 11th, he was going to charge us $100 a day. & If it didn't go through, that he was going to keep out earnest deposit. We also found out in the mid-of everything that though I was pre-qualified on my own, Arizona is a community property state & that my husband's not so great credit was going to affect everything. After we had paid the $1800+ to everyone (title company, inspector, Country Wide) they said we absolutely needed a co-signer. If we did not get a co-signer, we were going to lose the deal & the $1800 we put into it already would have been a waste.
We got my parents to co-sign. My father has immaculate credit. They said everything was good, everything was GREAT & that we would be in the house! So AFTER March 11th, came & went, the loan officer said she just couldn't get us the deal. We tried 2 other mortgage companies & they couldn't do anything for us either. We lost $1800+ & a great house.
I work for an insurance company making $42, 000 a year & have worked with my company for 2 years now. I have a great job & benefits. I have a very limited credit history. I don't have bad credit, just not enough. After this whole ordeal, I tried calling back the title company & no one returned my calls. I contacted the BBB. They have yet to answer my calls & emails. I guess everyone is just busy spending my money & laughing about "The poor fools that thought they were going to buy a house."
By the way, our friends that were pre-qualified before us, they bought their home. The two of them together make less than me, they don't have good credit & are about to lose their house. They've only been living in it for two months.
I cannot fathom the thought of why the government let them buy a house they couldn't afford because they had more credit, not better, just more credit than I do. & I, my husband & I, can afford a house right now with the homes for sale in AZ but couldn't get a home. & COULD NOT for the life of us find someone that could help us! That is what bothers me the most!
We were only told that I need to build my credit. Can you take a guess as to how many times I've applied for a credit card? (This would be my first credit card by the way.) They all said I had too many inquires on my credit within the last 6 months. Funny, & the loan officer told me all mortgage inquires would show as 1 inquire if they were from within 30 days. I don't think so.
So now, I am pretty much f*cked. It's ridiculous how this effed up government works & how there is NO HELP!
The moral of this story, please know that a pre-qualification is NOTHING. Don't be fooled, read about everything that involves the home-buying process. If something doesn't feel right to you, listen to your instincts. Our friends are about to lose their home because their loan officer fooled them into thinking they could afford their house. We know of another couple that just got their keys a few days ago, & we know they will lose their house too. Make sure everything is calculated correctly. Ask all the questions you need to, to feel comfortable with your decision. & If you find your "dream" home, don’t over pay! There are plenty of homes right now for sale, especially in Arizona for GREAT prices! What my husband & I have learned is that, once we are able to buy a home, we aren't going to go for the AMAZING home of our dreams what we can barely afford, we are going to buy the best deal on the cutest house & MAKE it our dream home! :)
I hope someone can learn something from our mistakes.

Short Sale Process
Below is a timeline of the life of this file. We had originally been told your short sale process was 45 to 90 days. We are now somewhere around day 140 with no end in site.
I faxed the short sale packet to Country Wide on Jan 27th and again on Feb 3rd. I was told that it was uploaded into your system on Feb 1st and that the Short Sale process took any where from 45 to 90 days. On Feb 4th the file was opened and I was told it would take 7 to 10 business days to assign. After several requests for assignment to a negotiator the file was finally assigned on March 6th to a Mark Lewis. I was told he had 15 days to review. On March 13th the file was then re-assigned to a Celia Medrano, and I was also told she had 15 days to review the file. When I called in for a status update on 4/15/09 I was told that they needed updated pay stubs and bank statements. I faxed the requested documents in on 4/20/09. On May 4th I received an email from Cilia asking for updated pay stubs and bank statements because the ones I had sent in at the end of Jan were out of date and for the sellers to fill out and sign a Form 1126. I emailed Celia the requested documents on May 6th. On May 12th (2 months after Celia was assigned the file) our file was assigned to Stacey Johnson a second phase negotiator, I was told she would have 30 days to review the file. I called in today June 15th to get an update on the file and was told that Stacey's work load was to much and she had passed the file to you for review.

LYING ABOUT MODIFICATIONS
We wanted to let everyone know that mortgage lenders are still deceiving the American people and the American government regarding loan modifications. We hear in the news everyday how the U.S. housing market is "bottoming out" or "finally stabilizing" or "sales are picking up". But the reality is that it is not. Not for homeowners whose lenders are corrupt, that is.
Please do not misunderstand. There are lenders who are doing their best to help homeowners and we are pleased they are now generally making a effort to work with homeowners and keep them in their homes. We applaud those lenders/banks. However, we wanted to bring to your attention a particular lender - Countrywide Financial (now operating as Bank Of America Home Loans).
We are sure you see comments all over the internet on how this lender is blatantly employing forestalling tactics to deceive the media, government, and the American public. In our opinion, this lender has absolutely no intention of complying with President Obama's American Recovery and Reinvestment Act of 2009 and has no intention of keeping homeowners in their homes. Countrywide Financial's website says they have a "commitment to supporting the Making Home Affordable program" but that is a lie. We have filed numerous complaints regarding Countrywide Financial for their refusal to grant us a loan modification on our home even though we meet the criteria.
The Superior Court of the State of California for the County of Los Angeles Northwest District issued a court order for Countrywide Financial to provide loan modifications (Case No. LC083076, California Attorney General and The People vs. Countrywide Financial). Though we were not part of this particular lawsuit, our situation still meets the criteria described in the settlement. Also, included in the settlement was for Countrywide Financial to furnish to the California Attorney General a list of account numbers of those loans which have been modified. I doubt, to this day, they have sent any tangible information to the attorney general.
Here's the deal:
1) Countrywide is NOT MODIFYING loans despite what they tell the government, the media and the American people.
2) Countrywide is violating court orders and is in contempt of court.
3) Countrywide received TARP funds and yet they openly refuse to abide by the mandatory Obama loan modification guidelines.
Bottomline: Countrywide Financial is STEALING our taxpayer bailout monies!
For those who are experiencing loan modification issues similar to our situation, please seek advice from an attorney AND DO NOT BE AFRAID TO LET GOVERNMENT OFFICIALS KNOW ABOUT YOUR LENDER REFUSING TO GRANT YOUR MODIFICATION (if you qualify for it). Write to your Congressman or Congresswoman, write Housing and Urban Development, your state's attorney general, your state's housing departments, your state's consumer affairs, your governor, the Better Business Bureau, the Federal Trade Commission, the Department of Real Estate, even write to the President of the United States, the Vice President of the United States, the Office of Public Liaison, write...write..write...or fax...fax...fax...or email..email...email..or call..call..call. Nonrefundable $400 Application Fee
On Mar 30, 2009 I spoke with a loan analyst (Corey Brown) and completed an application for a refinance over the phone. At the time of our phone application, it did not occur to me that a refinance loan with 1.5% points was not advisable for individuals looking to sell their homes within 12 months nor did the loan analyst articulate the % definition.
I simply was interested in consolidating our primary mortgage with a HELC. I immediately contacted Mr. Brown and requested that the loan be calculated without points. Once he did, it was determined that there was no financial incentive to refinance at this time. I was told at that time that the $400 application fee was non-refundable. I immediately cancelled the loan application but still got the charge applied to my credit card and received a large package of documents from Countrywide within 7 days of the phone application.
My concern is that if I cancelled the loan application process within 12 hours of the initial quote, where is the $400 charge being spent???? I did not want any paperwork from them, there was no appraisal ordered, there was no out of pocket expense for them (other than the fedex charge to deliver unwanted papers.) This should be illegal!!!
On Apr 2, 2009 I submitted a request on the countrywide website under the messages > send comments section of our loan page. I have yet to hear back from anyone in customer service even though your website clearly states that inquiries will be addressed within 48 hours of receipt.

Hardship is a broad term
I experienced a job loss at the beginning of February and wanted to make sure that our loss of my income would not cause a hit to my credit rating. I contacted Countrywide to see if there was anything they could do to either lower my payment or interest rate so that the mortgage would become less of a financial burden right now (My account is spotless). I was just exploring all options to help keep the most $$ available to me.
After learning that I was not eligible to refinance because my loan amount was higher than my house was now apparently worth (since they were able to calculate the cheaper houses in the neighborhood selling but missed the more expensive ones), it was offered that I talk to someone about a loan modification that I might qualify for. Okay fine. But instead of transferring me, I was given another 888- number. So I called and sat on hold for 45 minutes only to find out I wasn't even close to qualifying for their "hardship" loan modification. Now, with every person that I talked to I started the conversation by stating that I was calling because I lost my job. Countrywide does not consider losing your job as a hardship, which is apparently the only way to get your loan modified. They said "we can do a hardship assessment once you get a job and maybe help you out with your payment amount then". REALLY? ARE YOU KIDDING ME? I thought not having a job was a pretty good example of the definition of hardship, and I told the representative this. I then asked her whether she had more option the help me if my loan was already in default. She confirmed. She was not amused with my inability to understand how they operate, so said thank you, and hung up on me.
My husband and I are plenty able to pay our mortgage in full each month and on time. I just thought that I would try to be proactive and protect myself from ruining my credit, should it get that bad for us financially and it come to that. Thank you Countrywide for rewarding those who are a burden by not paying and for taking a dump on those of us who continue to be fiscally responsible.
