Unauthorized billing
I went to the Bank of America branch in Lilburn, GA on July 22, 2008 to make a deposit consisting of some cash and checks. I am a server so I have a lot of ones in my deposit but I counted them in to two stacks of $100 consisting of mostly ones but some fives. I counted the money at least 4 times to ensure it was 100% right.
I went through the drive through window to make my deposit even though I thought it probably wasn't a great idea to deposit cash through the drive through. I sent my money to the teller and a couple of minutes later she says that the cash only comes out to $196 and if I want to make the deposit I will have to give them an additional 4 dollars.
I tell the teller that I have counted the money numerous times and tell her to send the deposit back. I pulled forward to recount the deposit and magically $4 in cash is missing. If she was going to steal I would think that she would have at least been smart enough to steal an even amount. I know it is just $4 but it could have been a lot more.
I went in to the bank and closed my account where they proceeded to tell me that I should keep the account open and just do business at another branch. What a joke, what is wrong with this bank that they would rather loose me as a customer than get the $4 from their teller and keep the account open. They can have the $4 but I am taking my account somewhere else.

$75 checking incentive
My boyfriend and I had just moved to California in February. We were banking with PNC in Pennsylvania and they aren't located in CA. I went with BOA because that is where my job banked so I figured that it would be easier. There was also a $75 coupon in the Val Pak for new checking accounts. So I went to the office, set up my accounts and he stapled my coupon to the back of the paperwork said that it would be there in my account in about 30 days. So, 30 days rolls around- nothing. 60 days rolls around- nothing. I called the number that is on the website and heaven forbid I speak to an actual person- I finally get to a person and they said that unless when he set up my account, he entered the code- they can't do anything about it.
I am in the process of looking for a new bank- all over $75 that they won't give to me.

Unauthorized fees
Hi my name is Sonia Buentello, live on 2301 Lafayette St, Laredo, TX. 78041. My Bank of America credit/debit number is 4744 7200 3125 1313 and I have been ripped off by BOA for more than 1300 dollars in a period of 11 months, this is not fair. There were many times when the amount of my debit purchase was less than 2 dollars and I was later charged 35 dollars because of supposed insufficient funds. The debit purchases would be put in P status then for whatever reason bounce and not go through. I figured if you use your card it should go through ASAP, not days later. I know this is a way for the Bank to make money. It is outrageous! I am a single mother of 4 and have been taken advantage of by this bank. Out of approx 37 or so charges, only 2 were refunded. The last straw came about two months ago when I used my debit card, then the charges had already cleared to C status, and then afterward I used the card a couple of times, and when I checked again the next day, the charges were already in C status were sent back to P status, this is when I realized that I was getting robbed by the people who are suppose to take care of my finances. Please help in getting me back some of these charges. My checking balance is $ –527.30, I could no longer afford to bank with Bank of America. I was forced to change banks.

Unauthorized draft
FIA Cardservices (Bank of America) offered me a settlement agreement for my past due credit account, but failed to mention that in order to secure this agreement they would be autodrafting a payment. I made my monthly payment as instructed and 2 weeks later, they tried to take more money out of my account. (They had my banking information from when I setup a draft months prior.) The payment cleared, so I had at that point made 2 payments for the month, and this created a chain reaction of bouncing in my account ending up in fees over $600+. The account rep agreed that I should not have been set up on a draft, and that I had not been properly informed. So she put in a request for a refund to my bank account. I was eventually told that I could not get any reimbursement for their abuse of my banking information, basically because of the settlement - since they were giving me a break, I wasn't entitled to any money back. If they did process the refund, it would cancel my settlement. That was the last thing I heard. Then today, I see that they went ahead and gave me a partial refund. When I call in to find out why I received a refund at all, when I was just told that I could not - the manager then tells me that they processed the refund but now they have canceled my settlement! These reps are NOT TRAINED TO UNDERSTAND WHAT THEY ARE OFFERING TO CONSUMERS. The first rep that offered me a settlement, DID NOT TELL ME that every single settlement agreement MUST have be paid with autodraft. Then the next rep that is "helping" me did not tell me that a refund to my account would result in cancellation of the settlement. How the hell am I supposed to make decisions to remedy this account, when these people do not know how to do their job and do not provide accurate information?
I have been told that they will offer me another settlement later this week... I guess that is their way of making up for their series of effing my account up! We shall see.

Scam charges
I want to report on Bank of America's shady policies concerning overdraft fees. I deposited a check into my account one day last month. I waited for it to clear, and when I returned to the bank, I was told the check HAD CLEARED and that I could draw on the money. My wife needed to make a wire transfer abroad, and after getting the bank teller's assurance that the check had cleared and that the money was in our account, she made the transfer.
A week later I am in the bank and make another deposit. Things are fine until I go online later that day to make an online payment and notice that my bank account is overdrawn $900.00!!! Now I was just in the bank earlier that morning with a teller smiling at me. Could she not have mentioned I was $900.00 in the red? Anyway, I go to the 'Personal Banker' immediately to find out what happened. Apparently, the check I had deposited a week earlier had bounced, AFTER my wife had already made the wire transfer with money that was not in our account. So even though I was told by Bank of America's own staff that the funds were available, they actually were not.
I asked the Personal Banker why my wife was allowed to make a wire transfer of $1500 dollars when the check hadn't cleared, and he responded that because I was such a 'preferred customer, ' the Bank gave me the courtesy to 'forward' me the funds (Of course, overdrafts would be charged for the courtesy.)
So now I'm overdrawn $900 dollars, and overdraft fees start to avalanche on me. Bank of America takes no responsibility, and the Personal Banker tells me that 'the computer' won't let him remove the overdraft fees. The Personal Banker also TOLD ME that Bank of America used to not allow customers to draw on funds that were not in their accounts, but that now they DO allow this because overdraft fees are such a large part of the bank's revenue.
I had been a customer at Bank of America for 15 years. I regularly make wire transfers at $50 dollars a pop. This bank may have made a mere $120 dollars on me this time, but they lost much more in potential future revenue. I hope I might warn others about Bank of America's policy.
Do not, I repeat, do not draw on any account until you have absolute proof that your check deposits have in fact truly cleared. Even the bank tellers will tell that you checks have cleared when in fact they have not cleared. If you then draw on these accounts you will be penalized with expensive overdraft fees. I recommend getting a hard copy of cleared checks before any more transactions with your account are made so that you can protect yourself from consumer exploitation.
Bank of America, as subtly told to me by the Personal Banker, relies on CONFUSION and MISCOMMUNICATION to lure you into this kind of mistake. This way they can hit you with several OVERDRAFT FEES. Then they will blame it all on the automated 'computer' system which cannot be over-ridden by the Bank of America staff. How convenient for them to pass the blame onto the faceless master computer.
This experience, along with a few other customer nightmares Bank of America has given me, has made me realize that big international banks cannot service the average American consumer. I am moving my accounts to a smaller local bank and I recommend others do the same.
15 years of customer loyalty meant nothing to Bank of America. I guess my next wire transfer fees will go to another bank now.

Over Draft charges
When you do an over draft Bank of American will reshuffle all the amount for the last 3 days by largest to the smallest, not by date. Then this will empty your acount quicker. I got 5 $35 overdraft charges all of the items were done the day before I the one I should have been charged for. On of them was $35 on a $2.00 charge.

Interest charged on loan fees
We took advantage of the supposedly interest free offer we received in the mail. There was a fee of 3% for the balance transfer, which was unusually high since it had no cap, but not unheard of.
When we got our first bill, there was 21.24% interest charged on the loan fee of $360. It was on the bill as a cash advance. I thought it must be a mistake, but no, they informed me that's what they intended. And the interest started accruing from day 1 of the advance. Isn't that cute? So for $3.60/month in interest they have royally pissed me off and I will tell everyone I think might need to know about this ridiculously greedy practice. One would think that with their bad rep in the news these days, they'd realize it's counterproductive to nickel and dime their customers in this manner.

Money fraud
Will someone please contact me if there is a class action lawsuit filed against Bank of America for the way they handle their online banking and overdraft fees? I have an attorney in the family and I am having him check in on it and see if I have a case. Its not so much that I get charged overdraft fees for going over my account balance when using my Visa check card. If I go over and get charged a fee, I deserve it. Its that BOA's online banking is designed so that you are FORCED into overdraft fees. Let me explain what happens and if you are a lawyer, please contact me because I want to sue this institution on behalf of EVERYONE LIKE ME THAT GOT RIPPED OFF.
Example: Lets say you don't have $10000 in your account at all times. If you did, there wouldn't be a problem. The problem arises when, like me and every hard working American who because of the economy or other situations, is forced to live paycheck to paycheck. Lets say are coming to the end of the week and you only have $10 left in your account. You get gas and you accidentally pump $11 in gas. You do not get paid for another two days so your account online is shown in red (negative). You borrow money from a friend to cover the charge. Its past the cutoff time at the ATM, but to make amends you deposit $11 in your account to cover the overdraft. You check your account online and it shows you have a positive balance of $10. You wake the next morning and your account is still positive so you figure you got the money in on time. Wrong! You got the money in past the cut-off time, so the money will not post until the end of business the next day, but the online banking shows a positive balance. You therefore decide that you still have $10 and so you use your card to make purchases. Lets say you make 4 purchases for $2 each and 1 purchase for $1.99. You check your account that afternoon (the day after you overdrafted and made the deposit) and your account shows a balance of 1 cent. You go home figuring you are OK, but instead you get screwed by BOA. That afternoon after the cut-off time, they charge you the $35 fee for the original overdraft. Being they use the 'largest transaction first' this fee gets placed for posting first and your 5 charges (worth $9.99) get placed in order of amount after that. Therefore your balance shows you being in the red for $44.98. Worse yet, now the five transactions you made will get overdraft fees if you don't deposit another $44.98 in your account by the cutoff time. The problem lies in that in most circumstances they post the $35 AFTER it is too late to make a deposit to cover the overdraft, therefore you are caught in a vicious circle of overdraft fees which unless you deposit a huge amount in the bank you cannot get out of.
I have spent well over $4000 in fees this year ALREADY and its only July. I have finally decided to drop the BOA account and get one elsewhere. I should have done it MUCH sooner. I should also have kept a written register of my transactions, but BOA made me feel as if their online banking was excellent.
If there is an attorney out there willing to take my case, please contact me as I will certainly jump on board and I am sure there are PLENTY of people out there like me, that has plenty of evidence to prove my case.
Moral of the story is STAY AWAY FROM BANK OF AMERICA.

Unauthorized billing
At the advice of a credit counseling service that is non profit I made arrangements with the 5 credit card companies I had cards with. BOA is the only one that is not paid off in full to this day. They actually collected 300.00 per month for one year while they decided whether they could accept the agreement. None of which went for the balance. I have paid over 5000.00 and still my balance has not gone down. It is the only card service which was unwilling to work with me to get my debt paid off. They are predators.

Scam charges
I opened a checking and savings account with Bank of America in 2005.I had direct deposit of my pension checks from VA and SSDI.In May of 2006 I received a check of $3.800 usd from England stating that I had won a lottery in England. I researched on line and the Bank existed, the account existed and the Lottery Service had a working number.I have been playing the German, Spanish, Phillipine, Austrailian and English lotteries on line for two years.
I took the check for three thousand eight hundred dollars to the manager of the Bank of America. I explained the details to him along with his teller and he deposit the check in my account would be ok. I made the mistake over the next two or three weeks of paying my bills, using my bank account in a normal fashion.
The check was returned to BOA from England. The risk department took $1135.00 out of my checking account and closed my checking account, reported my name to Chex Systems for a negative balance of -$2, 723.00 and did not pay the three checks that I had written without any knowledge of the closure of my account.
Ms Hilda Storts of the Risk Department of BoA stated that I should be mad at the issuer of the check not Bank of America. She also stated that I had deliberately withdrew my money over the weekend in order to 'beat the Bank of America out of their money???' When I pointed out to her that had I wanted to do so I could have closed my account and taken all of my funds away in the four weeks that it took for the check to be returned, she hung up on me.
I went to four or five different banks to open a checking account for my direct deposits and all of the banks ran a check of this Chex Systems found this item of dispute between me and BoA and said'No' I ended up using an online loadable MasterCard as a 'Bank' for my checking account.
