Refused to help modify mortgage
ASC/Wells Fargo have stalled and refused to modify my Mortgage, even though I have CANCER!!! They refuse to take payments and are contradicting themselvs every time I talk to them. They have kicked me out of the program for forgetting to sign one out of the hundred documents I sent them. I qualify for every single classification under the making home affordible program. I am 74 years old- never paid a bill late until I got sick. I am at the end of my rope. The late fees keep piling up, the attorney fees keep going up and up. It should be illegal and I hear it is.

POOR SERVICE!!!!!!!!!!
In May of 2010 a hail storm did significant damage to my home. I received an insurance check a couple of months later. The check was made out to me and Americas Servicing Company. The last 4 months I have had an extremely difficult time getting Americas Servicing Company to endorse the check. All of the work on my home is completed and has been completed for over 4 months. The companies that completed the work need to be paid but I can't pay them until I get the check endorsed. You would think that since I am a customer of Americas Servicing Company they would help me and do whatever they can to make this easier for me, but instead it is the complete opposite. They have made this extremely difficult and very frustrating. It is now December and I still don't have the check. I think that they are holding on to a lot of checks so they can earn interest on them. Stay away from this mortgage company if at all possible!

mortgage ripoff
This all started a year ago when i was changing homeowners insurance companies. my taxes and insurance are not rolled into my mortgage so i can change them whenever i want. Well, asc got involved in the matter and wanted to hold money in an escrow account because there was a 5 week lapse in coverage. they started taking my money and putting it into a unapplied fund account whenever they did not accept the mortgage payment becuase it was not the amount they were asking for so they did not apply it to my account they put it into a unapplied fund account where they can withdraw late fees, inspection fees, and any other fee they feel like charging. Now they say i have been behind a mortgage payment =for a year now. I have sent all my documents of all of my payments sent and still they will not correct the amount. Now they are sending letters saying that they will foreclose at a certain date if all money is not paid. Ever since wells fargo split and gave asc the mortgage contracts i have had nothing but problems. I have been a wells fargo customer for 15 years and never had a problem with mortgage until last year. What a mess. Collection agency calls everyweekend wondering why i am a month behind. unbelieveable.

Since my mortgage was sold to ASC I have had nothing but problems. The people anserwing the phones have no idea what is going on. I contacted the service center and asked about sending in half payments twice a month to make one payment per month. The rep said it was ok. Didn't realise that they were no accepting this and the money was just sitting in limbo. When I got this mortgage the property consisted of 18 acre and a house. The appraisal was for 5 acres and the house. I was able to sell 12 acres and contacted ASC to see about a partical dispersal so that I could continue to have a mortgae on the appraised property. I received to answers to this request. The first one was to file for a short sale and I would no longer have the mortgage. What the heck kind of answer was this. The second rep said it would cost 250.00 for an application fee plus %00.00 for an ASC appraiser to appraise the property and the rate of these approval was less then 10 percent. Good luck to anyone dealing with ASC.

Fraudulent company
I have applied 4 times for a modification with this company. I totally qualify as my husband took a 40% pay cut. They have have lost my paperwork 4 times, sent me to short sale 4 times (i am not under water on my house)and not even contacted me with their decisions. I have to call them and wait on the phone just to have them tell me they closed my file...again. I give up. Obama needs to regulate companies like these that are taking advantage of homeowner and this country. They even had the balls to charge me $95.00 to value my property for my modification without telling me they do this up front. I had to file a dispute in writing and only then did they remove the charge. Do not sign a loan with thiscompany or Wells Fargo. I bank with them and am now moving my money to my credit union. I cannot refinance so I am trying to sell my house just to get away from them. Please file a complaint with the FCC about their practices. The more voices the loader the cry.

Loan Modification Fraud
I applied for a loan modification after the death of my husband in September of 2008. After over 1 year and hiring a 3rd party I was mailed the loan modification approval letter and the new terms of my loan in October of 2009. I read over all the paperwork signed it and returned it the same day. According to all my paperwork I was to make a contribution payment of $0.00 to get my loan modification started and my new payments would start in December of 2009. I made my new payments in December and January. On January 4th 2010 I received a phone call from a collection agency telling me that I owed $762.38 to America's Servicing Company for my contribution payment on my loan modification. I reread my paperwork to make sure I hadn't made a mistake and called America's Servicing Company. I asked the representative I was speaking to to read my paperwork they had sent me. He read over the paperwork and told me according to may paperwork I did not owe a contribution payment and that this issue would be resolved. In the meantime I received a letter from America's Servicing Company that stated I was denied my loan modification and removed from it due to non payment of my contribution payment and I owed almost $8, 000.00 to keep my home or I could reapply for a new loan modification. I once again called Americas Servicing Company regarding this and get the same answer according to may paperwork I didn't owe a contribution payment and was assured this matter would be resolved in 72 hours. Its now almost 2 months later and my home is now in active foreclosure, they won't even except my February payment. I faxed them all the paperwork they sent me and I signed, but was told they would not honor the agreement. I have since contacted an attorney and all the news stations around my area. I'm ready to fight them all the way. Anyone who is interested please contact me via email. I would love to hear from you. They are crooks and its about time someone stood up to them. The attorney tells me they get away with this kind of stuff because most people just pay the money and go on and thats how these mortgage companies are making there money...I may be from the country but I'm no FOOL...I have kept copies of all my paperwork...I'm going after them no matter what anyone interested in a class action please contact me.

Non-Modification & Foreclosure Initiation
LOSS OF RENTAL & PROMOTIONAL INCOME:

Regarding payment status, I contacted my creditors, including ASC, in July of 2008 before I missed any payments because my tenants at both the primary and investment properties were withholding rent and moved owing money. Because I was not behind yet in my payments, both ASC and SPS advised they could not help me. Then when the winter set in, oil, transportation, operations and maintenance expenses, and continued loss of income made it impossible for me to satisfy my mortgage obligations. My salary has also been retarded for the past decade due to reasons that I shall not discuss herein.

COMPLAINT AGAINST LOAN MODIFICATION COMPANIES, PARTICULARLY FIRST UNIVERSAL LENDING:

Despite being behind in my payments, ASC never sent my paperwork to an attorney to initiate foreclosure proceedings until March 2009. I believe this is attributed to the fact that First Universal Lending -- the second company I signed an agreement with in order to assist me in obtaining a loan mod from ASC -- effectively cancelled their negotiations with ASC after I cancelled a fourth payment of $499.95 since our agreement was only for three such payments for a total of approximately $1, 500.

ASC INITIATING FORECLOSURE PROCESS DESPITE FIFTH ATTEMPT AT MODIFICATION:

Shortly thereafter, I received a Demand Notice and then a Summons Server named Mike hand-delivered a Summons & Complaint to me on Thursday night (June 18, 2009). Said document had been filed on June 10th, 2009. Now, I and/or my attorney have to file an Answer with the Court and ASC's attorneyby or before July 6, 2009 to ensure that ASC does not regain the property via default judgment.

Needless to say, I am very much alarmed at the way ASC has moved to advance foreclosure proceedings despite the fact we have been working to negotiate a modification for approximately a year now! Each time I submitted information, they issued a denial letter that contained expenses that were grossly above any information I provided.

I also submitted information showing how affordable the mortgage would be if the interest rate were dropped from 10% to 2%; my monthly payment would be approximately $1, 500 per month; I also advised I would be willing to pay the mortgage for 40 years to compensate for the adjustment!

I am not trying to discharge my fiduciary responsibilities. I do, however, need help and have learned a great lesson -- never enter into deals when you have to depend on gross and/or rental income to make the deal. Both are bogus assumptions. Net income is the only reliable indicator of a person's ability to pay, as long as that income continues.

I am a victim of the sub-prime predatory lending crisis and have been paying loans that average 10%. When the tenants were paying their rent, I could afford the payments, which I made from April 2006 to July or August 2008. When they stopped, my financials changed accordingly.

HOPE NOW: FAITH WITHOUT WORKS IS DEAD...
I do not want to lose my home and believe I qualify for President Obama's Home Affordable Program. I received counseling from HOPE NOW already. I am Client #106. What I, indeed WE ALL, need now is an affordable modification so we can move on.

Respectfully speaking, homeowners need more than Hope; we need modifications, NOW.

HAMP MODIFICATION GUIDELINES:
According to the HAMP Calculator, with a monthly mortgage of $3, 248 and a gross income of 6, 324, I am paying 51% of my gross income for the first mortgage. More realistically, however, is that I only bring home $4, 200 as my net income, the debt to income is a whopping 77%!!! when you add one rent totaling 900 or $650 (75% allowance), the debt to income is about 60%.

SUMMATION:
Despite the denials, I have submitted a fifth modification request to ASC, and respectfully request that all Foreclosure actions be ceased. I called the company on 6/17/09 and they advised that they received my fifth hardship letter and that they were effectively canceling the short sale. Nevertheless, on the very next day, Mike served me a Summons & Complaint. Failure to provide an Answer within 20 days (before July 6, 2009) could be problematic!

I would appreciate any assistance you can provide.

Misleading Information and adverse credit reporting
I recently modified my mortgage with ASC, during the time they were reviewing the loan mod. I made all payments as described in our agreement. The new contract clearly states that my 2-1-09 payment was moved to 6-1-09. I was informed no payment was due until 6-1-09. They have since been reporting the 2-1-09 payment as delinquent, first a 30 day late on my report and now a 60 day late. When I asked about making payments they told me they would hold any payments in suspension pending the outcome of the modification agreement. By their own words they told me they would not apply these payments. As a result I could not have made any payment at the time they are reporting me delinquent. Now my credit is ruined, all my credit card companies have now either lowered my limits or canceled my cards altogether. I have suffered irreparable damage as a result of their actions. When I finally got a response they told me that I was responsible to make my payments anyway. This was impossible because they held payment in suspension. Since I signed the new agreement almost a month ago, I have heard nothing from them.

MORTGAGE
THE WORST CO. OF ALL TIMES. WAS APPROVED FOR MODIFICATION. SENT ONE PAYMENT AND WAS READY TO SEND THE SECOND ONE WHEN I RECEIVED A LETTER IN THE MAIL STATING MY MODIFICATION WAS DENIED. WHAT A BUNCH OF CRAP. ASC STATED THEY WERE NOT GOING TO FORECLOSE BUT I RECIEVED A LETTER STATING THEY WILL BEGIN FORECLOSURE ON APRIL 30TH.

Fraud and cheating
I have been trying to modify my loan since July 2008. I couldn't afford my taxes and mortgage due to an unexpected medical and auto expense. When they agreed to pay my back taxes for me and slightly increase my monthly payment I thought I was rescued. My statement now says I owe $5, 028.54 they added those onto my payment along with almost $500 in fees and I don't even know what they are for. When I called them said my account is in review so they are placing my payments in a unassigned account and, will continue to do so as long as my account is in this status. I've completed the same paperwork 3 times because they claim they don't have all the proper documents to proceed. When I went over it with the loan mod dept they said why do I have $300 in entertainment on my expense sheet. I have a copy of it here and it's not stated anywhere on the paperwork I never put that on the documents. Cory informed me that errors are made which can effect their decisions. So I have to start all over again. After reading all these complaints, I figure what is the point. It's clear they have no intention of helping me at all. I've gotten no where with this company. The customer service dept who I've gotten to know over the past 8 months could care less and they encourage me to leave the property if I can't afford to keep it. I've finally accepted a tenant thinking I'm saved and can make my payments no problem. I'm afraid to send them anymore money since they aren't even applying it to my account. I fear they are going to take my home anyway. Now that they expect me to pay all the taxes now. If I had it I would of paid them myself directly like I have always done in the past. I'm so confused. I've put everything into making my home nice for my son. If they think I'm not going to go down without a fight their crazy. If I have to move I'm taking everything including the drywall with me. This is B.S.
