Beware
I’m losing my home because of this awful company please any help would be greatly appreciated I’m in the midst of foreclosure I had lost my baby sister in the summer of 2007 and then found out I was pregnant well I got a little behind being off of work dealing with my loss of my sister...then I had to go on maternity after having a hard delivery with my son. they will not work with me saying I’m behind like 6000 and wanting me to come up with all of it or they are going to take my home what can I do.

Collection practices/procedures
Attempting to catch up on mortgage. Payments fell behind when I lost my job. Made payment 3/24/08. They applied it to my account, the cut a check dated 4/3/08 and sent it back. I then fedexed 2 payments, one on 4/9/08 and one on 4/16/08 totalling over $2, 400.00 Called and called, was told they would note my account. Finally spoke to someone on 4/21 who said I was in foreclosure, they were going to send my 2 checks back, I was on a "short sale" list. Never served with paperwork for foreclosure, never sent certified mail. Am attempting to get mortgage reinstated with some type of repayment plan. Sending them multiple documents twice, calling. Seem to be getting the run around. They are trying to push me towards the short sale. Advised I do not want that - I want my mortgage reinstated. Turning me over to a negotiator but, after doing some research, am finding out that their neogiation process is a scam, they tell you to wait a couple months and they'll work on it. Also, I worked wiith a woman who went through this exact same. They never called her after telling her that he account was with a negotiator and they were going to foreclose.
They will not accept any payments from me and I don't want a short sale or a forecosure - I'm working very hard to catch up. They need to be stopped from stealing people's homes right out from under them. They are crooks.

They're deceitful
We paid our mortgage on time for over 2 years. Our loan was due to adjust. We applied for a modification in 11/07. Heard nothing, called and called. Finally in March of 08 after months of nothing, we were told we were approved for a loan modification. When we received the paperwork in April of '08 it was totally different than the verbal approval. There terms are something we cannot do. We did not agree to those terms. Our home is being sold May 22. Please do not trust these people. They lie, lie, lie. Be careful when you enter into an agreement with this company.

Idiots, don't know what they're doing!
This comp and it's employees have no idea what they are doing. Send this via fax, they say. The Lawyer does. AND he sends it USPS. We don't have it they say. Call us after 48 hours. Still they don't have it. Then they give me TWO fax #'s and tell me to fax it to both #'s. Then I talk to a guy who is speaking English but I can't understand a word he is saying, sounding like he was from the ghetto. "There's nothing we can do. We can't call the auctioneer." When I get to the Trustee's Sale the auctioneer calls them to find out any last details i.e. "is there a postponement or a cancellation?" We can't talk to you, your not the mortgagor. The mortgagor is dead, you idiots. Of course you can't talk to him. We sent you the death cert and letters of Administration. This property is in probate and we've told you that a dozen times. This company needs a class action lawsuit against them.

Home Mortgage Loan
My home loan was sold to America's Servicing Company (ASC) about 2 years ago. From day one I have had nothing but problems with them. It all started 3 months after they took over my loan... they changed my escrow amount and did not notify me, when I was making my payments they were about 30.00 short every month. Because they typed in my phone number wrong, they were calling a phone number I used to have 18 years ago. Anyway, they were holding my payment in suspension untill they got the next payment, they would take part of the second payment and apply it to the first payment, after a few months they would take what was left charge late fee's and then put it to principal without contacting me. What this did, every 3 months it would make me fall behind by 30 days. Once it hit my credit I contacted them (since they never contacted me), to find out what was going on. Bottom line they blamed me and refuse to remove the mark from my credit. Less then 30 days after this mess started, the adjusted my rate to 10% from my 5.7% rate. So I contacted them again and they offered me the possability to lock in a 30 year rate, but I needed to give them personal financial information. After playing cat and mouse with them for 6 weeks (giving them the same information 4 times), the sent me a letter saying "It is not in our best interest to lower your rate at this time." WTF!!! I cannot refinance because they hurt my credit score... so I am being forced to put my home on the market so that I do not have to forclose on it. They have completly done everything wrong to me... and have no desire to help me in any way shape or form. :-(

I hope that something is done about this horrible company soon!

Awful service!
We've been paying our mortgage since this company took our mortgage on time. But it was only beginning of this year that the income was very tight and we required a little help. My friend told me that their mortgage company gave them a 2 month break just to be back in track, and that's w/out interest at all. So that gave me an idea to try it with our mortgage company.

I called today, but unfortunately i was told that their company don't do such a thing. The only way they can help us is to delay the payment and then they will submit us to collection agency. We don't want to be under collection agency, we are asking for a little break. Don't they even have any compassion or heart to help those in need. I've read a lot of complaints about this company and we totally agree with them. As a matter of fact, we made a very big mistake of refinancing. We use to be under Countrywide and this broker name Anita Adams called and gave this all nice offering about how we can make our mortgage better but it was the reverse of it.

We wanted so bad to lower down the interest rate of our present mortgage but because of the bad economy we were forced to used our credit cards to meet our needs and we think that's the cause why our score went down. But were never late and we made sure that all our debts are paid on time. It was only during the beginning of this year that we started to have our financial difficulties.

We hope you can help us in our situation, and we hope that this company learned better ways to accommodate their clients and not choking them. We understand its business, but in any situation there is always consideration and solutions.

How can they sleep at night!
We got a letter from the mortgage company yesterday, with the check we sent them two weeks ago to catch up on the house payment attached to the letter, telling us that they could not accept the check because it was not in "certified funds." Not once did they ever mention sending certified funds, but this isn't the first time they have refused to take a payment either; last time it was a money order. They go on to tell us we need to contact their lawyer because the loan is in foreclosure status at this time. This has really teed us off because this company has been nothing but a thorn in our side since they took over. Mind you, we didn't request this company; the company we did have closed down and sent all their existing mortgages to this current company. We have also come to find out that we are not the only ones experiencing problems with ASC (America's Servicing Company). Anytime they have called here, we pick up the phone and there is a re cording for us to call them back. So, we call them back and get a recording there is no one available to speak with us. The one or two times we did actually speak with someone, they said the letters we sent them (giving them permission to speak to me in husband's absence) had to be voided because husband's social security number was not on them; again, we were never told to enter his SS# on any form of correspondence with them. Too, husband applied for an extension and apparently THAT was ignored as well because we never heard from them. We are in the process of getting a reputable finance company to take over this mortgage. ASC has never even tried to work with us no matter what when we send payments, try to talk to them on the phone, correspondence. Luckily, I have all correspondence to and from this company should the need arise to take this to court, which I hope does not happen, but this company has really caused us problems.

Scam and cheating!
I was appalled in speaking with America's Servicing Company, after they paid my property taxes and tacked on $11,000 to an escrow account. I'm a realtor and mortgage broker who is watching my 20year careers "go to hell in a handbasket" because of the horrible economy in this country! I also have a third job and tried to ask America's Servicing Company to please do a loan modification for my perfect payment history loan with them. They refused, saying that a Loan Modification would only be considered if I was in default on my loan! Now isn't this very interesting - I have a perfect payment history with ASC for 18 months, and they want me to go into default in order to request a loan modification! Well instead of modifying the loan, they jacked up my mortgage payment by $1,000 to $2,467.00 per month! This is so absurd! I also asked about a refinance, as Wells-Fargo is the "hidden bank" holding the mortgage as the investor, and was told that my interest rate of 7.795% would go to "double digits" if refinanced! Once again, how can this occur, as I have a perfect payment history with America's Servicing Company! This ASC is a RIPOFF and should be put out of business! They tell you to write to them about any problem you may have and never answer the correspondence. Then when you call them and demand to speak with a Supervisor, this is the end result!

I hope that ASC is put out of business for unfair business practices. If anyone agrees with me, let's start a class action suit against these unscrupulous companies!

Terrible experience!
Our 1st loan was sold from Fremont Bank to America's Servicing Company (ASC) and our loan has adjusted after the second year. We asked ASC for a loan modification and sent all the necessary requirements. We were never late on our payments and have an excellent credit. It took them 75 days to give us a decision... and denied us our request because we have a deficit on our budget of $2,000. But that's because ur mortgage payment went up by $2,000. They advised us to foreclose the house and did not offer any other options. They're supposed to work with us! What a brilliant idea from a "mortgage consultant" of ASC. It seems that all they want is your money. They don't care for you!!!

Fraud
We fell prey to what we now understand to be predatory lending but our main issue is with our mortgage servicer.

When we first fell behind on our loan due to my medical issues, we contacted our lender. We were told that nothing

could be done until we were at least 120 days behind and that we could not start any modifications until that time.

This did not settle well with me, however they were the lenders and we figured they knew their business. So we sent

in a hardship letter explaining that my health had failed which left me in and out of the hospital. This led to my

husband moving to a higher paying job and losing our medical insurance for the family so that he could do contract

work. We waited until the 120 days had passed and then called again. At this time we were told that we needed to

request a loan modification package, which we did. Weeks passed and still no package arrived. We called again to

make another package be shipped. This time we did get a package. We filled out the paper work and sent all of the

documents back in. We were told not make any payments on the first mortgage. We also have a second with them and

qualified for a repayment plan which we had continued to honor. We were told that if a payment came in during the

loan modification it would kick us out of the loan mod. ASC (America's Servicing Company) said that foreclosure

proceedings would be on hold until the loan modification was either accepted or denied. We were told to rush and

send $5012.95 as a deposit. So we called again and again often three times a week to double check status and

confirm that a loan mod would not be possible if we made any payments, yet the response was the same. Then we got a

letter stating that we were in default. We called ASC again wanting an explanation. We were told not to worry

that everything was fine and that they were still waiting for the loan mod to come back. That was in October.

Well, sadly enough, even after calling day after day, December came and we were preparing our son to leave for the

Navy. Right before Christmas we get a post on our door for relatives to find, stating that our home would be

auctioned Jan 2, 2008. We called ASC immediately only to be told the exact same thing, however this time I also

called the attorney on the Trustee Sale notice. When I called Ndex-West, the attorneys, I was told that nothing

was on hold, nor had it been. That the lenders were foreclosing. So I called back and fourth between the two only

to keep getting lied to by the lender.

Indeed our home was to be auctioned off right from under us.
